This Terms & Conditions (“T&Cs”) govern the retreat fee and deposit payment in connection with your (hereinafter “you”) participation in the personal development and wellness retreat “The Great Unschedule Retreat” (“Retreat”) organized by Breath and Being OÜ, registered in Estonia (registration number 17187681), located at Narva mnt 5, Tallinn 10117, Estonia (hereinafter referred to as the "Organizer").

1. Deposit Payment

1.1 The deposit amounts to EUR 250.00 (two hundred and fifty euros) and is required to secure your place at the Retreat. It serves as your commitment to attend the Retreat and covers expenses of the Organizer.

1.2 The payment of the deposit constitutes acceptance of these terms and conditions.

2. Cancellation

2.1 The deposit is non-refundable and will be retained in the event of cancellation by you as a lump-sum compensation for expenses. This includes but is not limited to cancellation in case of:

- Personal circumstances
- Health issues
- Travel restrictions
- Visa denials
- Force majeure events

2.2 The deposit cannot be transferred to another person or future retreat date.

2.3 The payment of the deposit does not guarantee participation in the Retreat until the full balance of the Retreat fee is paid according to the payment schedule provided.

2.4 The Organizer reserves the right to decline any application or cancel any booking with full refund of the deposit at its discretion.

3. Retreat Fee

3.1 The total Retreat fee amounts to EUR 2.550,00 (two thousand five hundred and fifty euros) and can be paid in the following ways:

- Full payment (single installment)
- 2-month payment plan
- 4-month payment plan

3.2 The non-refundable deposit of EUR 250.00 is applied to the total retreat fee regardless of payment option chosen.

4. Payment Plans for Retreat Fee

4.1 Full Payment

Complete payment of EUR 2,550.00 due within 7 days of acceptance
Includes EUR 250.00 non-refundable deposit due upon signature of Agreement
total amount of EUR 2,800.00 (including deposit)

4.2 Two-Month Payment Plan

Initial payment: EUR 250.00 non-refundable deposit
Remaining balance divided into 2 equal monthly installments of EUR 1,326.00 including a fee of EUR 102.00 for installment payment
Automatic payments processed on the same date each month
All payments must be completed 30 days before retreat start date
total amount of EUR 2,902.00 (including deposit)

4.3 Four-Month Payment Plan

Initial payment: EUR 250.00 non-refundable deposit
Remaining balance divided into 4 equal monthly installments of EUR 663.00 including a fee of EUR 102.00 for installment payment
Automatic payments processed on the same date each month
All payments must be completed 30 days before retreat start date
total amount of EUR 2,902.00 (including deposit)

4.4 The Organizer reserves the right at its full discretion to offer an alternative payment plan.

5. Payment Terms

5.1 All payments must be completed at least 30 days prior to arrival date.

5.2 Failure to complete payments according to the chosen schedule may result in:

- Loss of retreat place
- Forfeiture of paid amounts
- Cancellation of booking

6. Cancellation and Refund Policy

6.1 The deposit in the amount of EUR 250.00 is non-refundable.

6.2 Refund schedule for remaining payments:

- 90+ days before retreat: Full refund minus deposit
- 89-60 days before retreat: 75% refund minus deposit
- 59-30 days before retreat: 50% refund minus deposit
- Less than 30 days before retreat: No refund

6.3 All cancellations must be submitted in writing to support@breathbeing.com

6.4 If the Organizer cancels the Retreat for any reason, the Participant shall receive a full refund of all payments made, excluding the deposit, or shall be offered the opportunity to transfer their booking to an alternative Retreat date.

7. Payment Processing

7.1 All payments are processed in Euros (€).

7.2 Payments are processed through Stripe, a secure payment platform.

7.3 Automatic payments will be charged to the card provided during registration.

7.4 Failed payments must be resolved within 3 business days.

7.5 The Organizer is not responsible for any currency conversion fees or charges imposed by your bank.

7.6 Chargebacks are not permitted and will be rebilled.

8. Transfer Policy

Retreat bookings may be transferred to another person with a EUR 150.00 administration fee under the following conditions:

- Written notice
- New participant application approval
- Payment of transfer fee by original attendee
- Completion of all necessary documentation
- Transfer request received at least 30 days before retreat.

9. Default and Termination

9.1 The Organizer reserves the right to terminate the Agreement including these T&Cs, especially but not limited to following cases:

- Two or more payments are missed,
- False information is provided,
- T&Cs are breached.

9.2 In the case of termination, the Organizer reserves the right at its full discretion to:

- Forfeit the Retreat place,
- Retain the paid amounts,
- Initiate debt collection procedures for the outstanding amounts.

10. Force Majeure

The Organizer shall not be held liable for failure to perform its obligations under the Agreement due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or political instability.
In such cases the Retreat may be rescheduled, the credit may be issued for a future retreat, and alternative arrangements will be proposed by the Organizer.

11. Data Protection

The Organizer collects and processes personal data in accordance with the General Data Protection Regulation (GDPR). Data is collected solely for the purposes of Retreat administration, communication, and safety. It will be stored securely, not disclosed to third parties without consent, and deleted when no longer required. The Participant retains the right to access, correct, or request deletion of their data at any time. The Organizer acknowledges its responsibility under applicable data protection laws and agrees that, where it engages subcontractors (subprocessors) to process personal data on behalf of the Participant, it shall enter into a written Data Processing Agreement (DPA) with such subcontractors.

12. Changes and Modifications

The Organizer reserves the right to modify these terms with written notice to participants.

13. Governing Law

13.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.

13.2 Any disputes shall be subject to the jurisdiction of the courts of Munich, Germany.

13.3 Mandatory consumer protection laws of the EU Member State of the Participant’s habitual residence remain unaffected.

14. Severability

Should any provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a valid and enforceable provision shall apply that most closely reflects the economic intent of the invalid or unenforceable provision. The same applies in the event of any omissions in these Terms and Conditions.
